General

Throughout the site reference to Cumbria Wildlife Trust shall mean “Cumbria Wildlife Trust Limited” whose address for service is Plumgarths, Crrok Road, Kendal, Cumbria, LA8 8LX. The contract is always between the buyer/customer and Cumbria Wildlife Trust Limited and governed by UK law and in particular the Distance Selling Regulations in force at the date of the order being placed. Any dispute shall be conducted in UK Courts. Nothing in the web site shall exclude the buyer from any rights granted to them under UK Law.

Price

Unless otherwise clearly stated the price shall include VAT and delivery (which will be clearly specified at the checkout stage before the order is completed). “Special Offers” will be clearly stated and only available while displayed and maybe withdrawn without notice. Buyers shall be liable for any additional taxes and duties that might arise from the goods being exported to their country from the United Kingdom. Cumbria Wildlife Trust Limited  cannot be held responsible for any claims for such taxes and duties or any damages or loss arising from the buyer failing to make enquiry as to any such liability.

Payment

All payments must be paid in full and in advance before goods are dispatched. Payment shall be made by credit card/debit card online.  Alternatively the buyer may telephone with credit card details. Any other method of payment must be made by prior arrangement with Cumbria Wildlife Trust Limited.

Delivery and claims

Cumbria Wildlife Trust Limited will do its best to ensure prompt delivery but will not be obliged to offer any compensation for disappointment suffered. If the delivery cannot be made due to discontinuation of goods then any sum paid by the Buyer will be refunded and the Seller will notify the Buyer by email to the address given at the time of the order. The refund will be made as soon as possible and, in any event, within 30 days of order. Cumbria Wildlife Trust Limited will not be obliged to offer any compensation for disappointment suffered.

The buyer shall accept mutually arranged delivery. If the goods are undelivered, the obligation is with the buyer to negotiate re-delivery with Royal Mail or the courier. The buyer shall upon delivery examine the Goods and shall promptly (in any event within 7 days of delivery) and notify Cumbria Wildlife Trust Limited  by telephone or email, where appropriate, of any apparent damage, defect or shortages.

Guarantee and Warranty

All goods supplied are subject to manufacturers guarantees where relevant.

Cancellation

Upon receipt of the goods, the Buyer has 7 days in which they can choose to cancel the order and return the goods for a full refund. However, the customer will be responsible for return of the goods in a saleable condition to the Company's address at their cost.

Descriptions

All drawings, descriptions, illustrations, weight and dimensions given in this website are approximate and intended for general guidance purposes only. They may be subject to change without prior notice to the Buyer.

Copyright Warning

All images and content on this site are copyright to Cumbria Wildlife Trust Limited  and may not be copied subject to any downloadable images that the viewer has obtained a licence for. Breach of copyright is theft and we will seek a prosecution and both criminal and civil damages together with an injunction for breaches.

Access

You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

Registration

You warrant that:

• The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects;
  and
• You will notify us immediately of any changes to the Personal Information by contacting us by e-mail, or calling us on  01539 816300.
• You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

Our rights

We reserve the right to:

• modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
• change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
